Terms of Service

These Terms of Service ("Terms") govern your access to and use of all services provided by Zebra Hosting Cloud ("we," "us," or "the Company"). By purchasing, accessing, or using any of our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use our services. By agreeing to these Terms, you represent that you meet these requirements. We reserve the right to refuse service to anyone at our sole discretion.

2. Service Agreement

Our hosting services are provided as described on our website at the time of purchase. Provisioning is automated where applicable. VPS and dedicated server plans are typically delivered within 24 hours of confirmed payment, though delivery times may vary depending on verification requirements or technical provisioning conditions.

Service features, pricing, and availability are subject to change. We will make reasonable efforts to notify customers of significant changes in advance.

3. Service Availability & Uptime

Zebra Hosting Cloud strives to maintain a 99% uptime across our infrastructure. However, we do not guarantee uninterrupted service. Downtime may occur due to:

  • Scheduled maintenance windows (we will provide advance notice where possible)
  • Emergency maintenance required to protect infrastructure security or stability
  • Hardware or network failures beyond our control
  • Force majeure events (natural disasters, power outages, third-party network disruptions)

Planned maintenance is typically performed during low-traffic hours and will be communicated via email or our status page. We are not liable for losses arising from service interruptions.

4. Acceptable Use

You are responsible for all activity on your account and must ensure your use of our services complies with all applicable laws and our Acceptable Use Policy. Prohibited activities include but are not limited to: distributing malware, conducting DDoS attacks, sending spam, hosting illegal content, or engaging in any form of fraud or abuse. Violations may result in immediate account suspension or termination without refund.

5. Root & Administrative Access

For VPS and dedicated server plans, you may be provided with root or administrative access to your server environment. You are solely responsible for the security and management of your server once access credentials have been delivered. We will not share or disclose your root credentials, SSH keys, or any other privileged access information with any third party under any circumstances, including law enforcement requests, unless compelled by a valid legal order from a competent jurisdiction.

You must take all reasonable steps to secure your server, including keeping software up to date, using strong passwords, and restricting access. Zebra Hosting Cloud bears no responsibility for data loss, security breaches, or damage resulting from your failure to maintain adequate server security.

6. Payment & Renewal

Fees are charged according to the selected plan at the time of purchase. All prices are displayed exclusive of applicable taxes unless stated otherwise. You are responsible for ensuring your payment method remains valid and that payments are made on time.

Renewal reminders are sent to your registered email address before your service expiry date. Failure to renew will result in service suspension. After a grace period (typically 7 days), suspended services may be permanently terminated and associated data deleted. We are not liable for data loss resulting from non-renewal.

Refunds are only available if you have not logged into the client panel or control panel following your purchase. Accessing the panel constitutes use of the service, and no refund will be issued after that point regardless of the plan or time elapsed. Full details are in our Refund Policy.

Chargebacks or payment disputes filed without first contacting our support team may result in immediate account termination and may be referred to collections.

7. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized account access due to your failure to secure your credentials.

8. Intellectual Property

All content, branding, logos, and materials on the Zebra Hosting Cloud website and platform are our intellectual property or are used under license. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Zebra Hosting Cloud, its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising from:

  • Your use of, or inability to use, our services
  • Service interruptions, downtime, or maintenance
  • Unauthorized access to or alteration of your data
  • Any third-party conduct or content

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total fees paid by you to us in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Zebra Hosting Cloud and its affiliates, officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, non-payment, fraudulent activity, or any conduct we deem harmful to our services, infrastructure, or other customers. You may cancel your service at any time from your client area. Termination does not relieve you of any outstanding payment obligations.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Zebra Hosting Cloud operates, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

We encourage you to contact our support team first to resolve any disputes informally before pursuing formal legal action.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on our website. Continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.
